Willem de Klerk (BComm LLB LLM) has been in practise for more than twenty years. Willem has a background in rights-based litigation and access to justice. Early on in his career he worked at a small law firm rendering legal assistance to individuals and communities engaged in anti-apartheid activities in farming communities around the country. He was subsequently part of the team who established the first public defender's office in Johannesburg. Willem later joined the University of the Witwatersrand where he spent many years at the Wits Law Clinic, including a four-year stint as Director of the law clinic, gaining experience on a broad range of legal issues. Willem has practised for his own account as an attorney since 1994. What started out as a general law practise has over time developed into a specialist litigation practise with strong emphasis on media law, freedom of expression and rights-based issues.
Consultant attorney Zanele Mbuyisa (BProc LLB) has vast experience in public interest law including class action lawsuits. She renders ongoing assistance to the firm as a consultant attorney, particularly in the fields of media law and training.
Tshegofatso Khunou (LLB) completed her articles of clerkship at the firm and was admitted into practise in August 2018. Tshego assists clients in media matters and general litigation in the High Court and Magistrate’s Courts.
Charl du Plessis (BA Hons LLB) is a former journalist who is currently completing his articles of clerkship with the firm.
We assist media houses as well as small independent publishers in both the print and broadcast media, in the following areas: pre-publication advice; assistance relating to pre-publication interdicts; litigation relating to defamation, privacy and dignity; media access to courts and tribunals; assistance with access to information; representation before industry bodies such as the press ombudsman and the BCCSA; as well as staff training on media law issues.
Assistance in privacy and dignity related matters; assistance relating to unfair discrimination; advice on rights to equality; freedom of expression and rights to property; damages claims arising from assault, police brutality, arrests and unlawful detention; advice on social media and its impact on the rights of individuals; commercial expression and advertising.
General legal services
The firm renders assistance in selected general legal matters, such as advice to small and medium business enterprises, the drafting of contracts including commercial lease and business sale agreements; the administration of deceased estates; the drafting of wills; and general commercial litigation.
